Welcome to SparkDay. By using our app and services, you agree to these Terms of Service ("Terms"). SparkDay is operated by Uplift Sols ("we", "our", "us").

1. Acceptance of Terms

By accessing or using SparkDay, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use SparkDay.

2. Eligibility

SparkDay is designed for families. Parent/adult accounts require a valid email address. Teen accounts are created by parent invitation only using invite codes. A parent or legal guardian must consent to teen participation.

3. Account Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials.
• Parents are responsible for managing teen accounts within their family.
• You agree to provide accurate information when creating your account.
• You agree not to use SparkDay for any unlawful purpose.

4. User Content

You retain ownership of all content you create in SparkDay (events, tasks, meal plans, etc.). By using AI-powered features, you grant us permission to send relevant content to our AI service provider (Anthropic) for processing. See our Privacy Policy for details.

5. Acceptable Use

You agree not to:

• Use SparkDay to harass, abuse, or harm others
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Use the service for commercial purposes without our consent
• Create accounts using automated methods

6. Service Availability

We strive to keep SparkDay available, but we do not guarantee uninterrupted service. We may modify, suspend, or discontinue features at any time. We are not liable for any loss resulting from service interruptions.

7. Intellectual Property

SparkDay, its logo, design, and original content are owned by Uplift Sols. You may not copy, modify, or distribute our intellectual property without permission.

8. Account Deletion

You may delete your account at any time from the Profile screen. Parents may delete teen accounts from the Family management screen. Account deletion permanently removes all associated data and cannot be undone.

9. Disclaimers

SparkDay is provided "as is" without warranties of any kind. Meal suggestions, schedule recommendations, and AI-generated content are for informational purposes only and should not replace professional advice.

10. Limitation of Liability

To the maximum extent permitted by law, Uplift Sols shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of SparkDay.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via the app or email. Continued use of SparkDay after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of applicable jurisdiction.
